Terms and Conditions

Contract

  1. Contract.
    The Owners manage the property and reserve the right to refuse any booking. If there is any breach of contract by you, the owners/manager reserve the right to re-enter the property and terminate the letting. Any contract for the letting of the property will be between M.C.C. & F.A. Heaton (the Owners) and you, and will be subject to these terms and conditions and any other special conditions made known to you at the time of the booking. The Owners accept no liability for any defects or unavailability of the property.

Booking

  1. Booking.
    A booking for Tagents Barn is accepted subject to availability (and confirmed by telephone or email), and becomes firm on receipt of the completed booking form with the 30% non-refundable deposit. The booking form and deposit must be received within seven days of the provisional booking by phone or email. Payments must be made in Pound Sterling.
    The person who signs the booking form must be a member of the party occupying the barn. The signatory agrees the terms and conditions of the barn on behalf of all the persons in the party and that person may not transfer the booking to another person without prior written consent from the Owners and/or their representative.

Security Deposit

  1. Security Deposit.
    We require a security deposit of £200.00 which is payable when the balance of the booking payment is made. The deposit will be refunded within 7 working days of the end of the booking, subject to no retentions being made.

Balance of Payment

  1. Balance of Payment.
    The balance of the rental fee (final 70%) is payable not later than 6 weeks before the date of arrival. If the balance is not paid by the due date, Tagents Barn will reserve the right to cancel the booking at which point the deposit will be forfeited.

Cancellation

  1. Cancellation.
    If you cancel your booking at any time, for any reason, no refund will be made for any monies paid unless we are able to re-let the property to another party for the same period in which case we will refund your monies less an administration fee of £100.00. We recommend that you take out appropriate insurance so that you are covered should you have to cancel involuntarily. Once a booking has been confirmed, the booking can only be changed or cancelled in writing.

Description of Occupancy

  1. Description of Occupancy.
    The property may be occupied for private holiday use only, and the tenancy created with this booking is neither an assured tenancy nor an assured short-hold tenancy. The number of occupants must not exceed 6 except with the prior written permission of the Owners.

Our Responsibilities

  1. Our Responsibilities.
    We will ensure that the property is thoroughly cleaned prior to your arrival and we will clean it once a week and change the bed linen and bathroom linen once a week if the letting is for more than one week. Additional cleaning is available by special arrangement.

Your Responsibilities

  1. Your Responsibilities.
    We expect the property to be left in a similar condition and state of repair as you found it, when you depart. If the property is left in an unsuitable condition at the end of your let then we will instruct professional cleaners to clean the property and the cost of this will be deducted from your security deposit. You will be fully liable for any damage done to the property or its contents during your let, and the cost of repairing the property or replacing contents will be deducted from your security deposit. Should the cost of repairs or replacements exceed the amount of the security deposit you will be liable for the excess.
    You must report any damage and/or breakages to the Owners as soon as possible.
    You must ensure that whenever the property is unoccupied it is properly secure and not cause a nuisance or disturbance to occupants of nearby properties.
    Please respect the fact that this is a working farm and that entry to the farmyard is prohibited and guests should be aware that large farm machinery uses the drive.

Smoking

  1. Smoking.
    For the benefit of non-smoking guests smoking is not permitted inside the property. Smoking is permitted in the garden area but please use the ash trays provided. Please remember the Barn is of timber construction so there is a high fire risk.

Linen

  1. Linen.
    Bed linen, bath, hand and tea towels and bath mats are provided and included in the letting. The towels etc are for use inside the Barn and are not to be used for swimming, sunbathing, beach use or otherwise.

Barbecue

  1. Barbecue.
    There is a gas fired barbecue for your use. Please ensure that the barbecue is left clean and empty at the end of your stay.

Pets

  1. Pets.
    We regret that pets are not allowed at the property.

Duration of Holiday Letting

  1. Duration of Holiday Letting.
    The letting is for the term stated in the cover letter. Letting commences at 16:00 on the starting date specified in the booking and ends at 10:00 on the end date specified in the booking agreement. Arrangements may be made for earlier access under special circumstances.

Services

  1. Services.
    All charges for gas, electricity, water, reasonable internet use and Sky, council tax and Value Added Tax are included in the holiday price.

Loss of Visitor’s Property

  1. Loss of Visitor’s Property.
    The Owners cannot accept any liability for the loss or damage to any belongings of the occupants or their guests.

Insurance

  1. Insurance.
    We strongly recommend that you take out appropriate holiday insurance to cover you in the event of having to cancel your holiday, for loss of belongings and for accidents which could occur during your stay.

Right of Entry

  1. Right of Entry.
    We want you to enjoy your holiday as uninterrupted and as peacefully as possible. There may, however, be occasions when the Owners may require access to the property, and in such circumstances we will try and give you reasonable notice.

Liability

  1. Liability. Your (and any members of your party) personal belongings and vehicles are left at the property entirely at your own risk and the Owners can accept no liability to you or members of your party for loss or damage to your personal property. No liability can be accepted by the Owners where you or your personal property suffer any loss or damage, disappointment, inconvenience or otherwise or where the performance or prompt performance of any or the Owners obligations is caused, prevented or delayed by any event which is beyond the reasonable control of the Owners, including war, threat of war, riot, civil strife, industrial action, terrorist activity, nuclear or natural disaster, fire, flood, adverse weather conditions or interruption to utility services. Nothing in these terms and conditions shall limit or exclude the Owners liability for death or personal injury arising from the Owners negligence or for fraud or fraudulent misrepresentation.
